CareLinc Terms & Conditions

These Terms & Conditions govern your access to and use of the CareLinc care management software platform, customer accounts, client portals, care tools, and e-commerce shop.

1. Acceptance of Terms

By accessing or using the CareLinc website, web application, admin views, portals, or e-commerce shop, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not access or use the platform.

If you are entering into these Terms on behalf of a care provider organisation, company, or legal entity, you represent and warrant that you have full legal authority to bind that entity to these Terms.

2. Eligibility & Authority

You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to register an account or purchase products through CareLinc. Minors, care participants, or individuals under legal guardianship may access client portal features only under the supervision of an authorized adult, care provider, or legal representative.

3. Account Registration & User Roles

CareLinc provides role-based access control (RBAC). Access levels include Organisation Administrators, Care Coordinators, Roster Managers, Care Workers, Finance Users, Clients/Participants, Representatives, and Shop Customers.

You are responsible for maintaining the confidentiality of your login credentials (email and password) and for all activities that occur under your account. You must notify CareLinc immediately of any unauthorized account access.

4. Customer Organisation Responsibilities

Customer organisations (including NDIS support providers, aged care providers, and health agencies) using CareLinc are solely responsible for:

  • Ensuring all participant and staff information entered into CareLinc is accurate, complete, and up-to-date.
  • Obtaining all necessary participant consents, legal authorisations, and privacy collection notices required under Australian law before uploading records into the platform.
  • Managing user account provisioning and promptly revoking system access when staff members or contractors cease employment.
  • Complying with their own statutory obligations under the NDIS Act, Aged Care Act, Fair Work Act, and relevant privacy laws.

5. CareLinc Is Software, Not a Care Provider

Core Platform Disclaimer

CareLinc provides software management tools, workflow automation, and documentation infrastructure for care providers. CareLinc is NOT a registered medical practitioner, hospital, nursing agency, or direct provider of disability or aged care services.

CareLinc does not deliver medical advice, diagnosis, nursing care, or emergency response services. All clinical assessments (including Barthel and Lawton scores), care plans, medication logs, and incident reports generated or stored on the platform remain subject to the independent professional clinical judgement of qualified care workers and medical professionals.

6. Platform Features & Capabilities

Subject to compliance with these Terms, CareLinc grants you a non-exclusive, non-transferable, revocable license to access and use the software modules enabled for your subscription account:

  • Client Profile Management, Intake & Emergency Contact Tracking.
  • Individualized Support Plans, Care Plan Wizard & Disaster Protocols.
  • Functional Ability Assessments (Barthel Index & Lawton IADL Scoring).
  • Rostering, Shift Scheduling, Service Requests & Attendance Logs.
  • Progress Notes, Medication Tracking & Incident Management.
  • Invoicing, Quotes, Financial Snapshots & E-Commerce Shop Ordering.

7. AI-Assisted Advisory Features

AI Suggestions Are Advisory Only

CareLinc provides advisory AI tools (such as Care Plan goal recommendations and lead summaries). AI outputs are non-binding drafts generated by automated algorithms. Users MUST independently review, verify, and validate all AI-generated content before incorporating it into participant care plans or clinical records.

8. Subscriptions, Fees & Billing

Access to SaaS care-management functionality requires an active paid subscription plan or formal enterprise agreement. Fees are billed in Australian Dollars (AUD) in advance on a recurring monthly or annual basis as specified in your agreement.

Failure to pay recurring subscription fees may result in suspension or termination of platform access. All fees are exclusive of GST unless explicitly stated otherwise.

9. E-Commerce Shop Terms & Orders

CareLinc operates an online e-commerce shop for medical equipment, assistive technology, and care supplies:

  • Product Availability & Pricing: Prices and product availability displayed on the CareLinc Shop are subject to change. We reserve the right to correct pricing errors prior to order dispatch.
  • Order Confirmation: Receipt of an automated order confirmation email does not constitute final order acceptance. We reserve the right to decline or cancel orders due to stock unavailability or pricing errors.
  • Delivery: Orders are dispatched to nominated Australian delivery addresses. Risk of loss passes to you upon delivery to the carrier.
  • Returns & Refunds: Unopened products may be returned in accordance with our Shop Refund Policy within 14 days of delivery, subject to restocking fees where applicable. Faulty or damaged items will be repaired, replaced, or refunded in accordance with Australian Consumer Law.

10. Australian Consumer Law (ACL)

Our services and goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL) contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth). Nothing in these Terms attempts to exclude, restrict, or modify any statutory consumer guarantees that cannot lawfully be excluded.

11. Customer Data & Intellectual Property

Customer Data Ownership:As between CareLinc and you, you retain all right, title, and ownership in and to all participant data, care plans, progress notes, and operational records uploaded to CareLinc by your account ("Customer Data").

CareLinc Intellectual Property: CareLinc retains exclusive ownership of all software code, interface designs, trademarks, logos, documentation, and underlying platform architecture. You must not copy, modify, reverse engineer, or create derivative works based on CareLinc software.

12. Acceptable Use Policy

You agree not to:

  • Use the platform for any illegal purpose or in breach of Australian privacy laws.
  • Attempt to gain unauthorized access to accounts, participant records, or system databases.
  • Upload malicious code, viruses, malware, or automate unauthorized data scraping.
  • Share login credentials across multiple unauthorized individuals.
  • Interfere with platform stability or bypass role-based security controls.

13. Security Responsibilities

While CareLinc enforces technical access controls, encryption, and audit trails, customer organisations must implement appropriate workstation security, strong password management, and prompt access revocation for departing staff members.

14. Platform Availability & Maintenance

We use reasonable efforts to maximize platform availability. However, we do not guarantee uninterrupted or error-free operation. Scheduled system maintenance and software updates are performed periodically, with advance notice provided where practicable.

15. Disclaimers & Limitation of Liability

To the maximum extent permitted by Australian law, CareLinc excludes all implied warranties not explicitly set out in these Terms. CareLinc shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the platform.

Where liability cannot be excluded by law, CareLinc's total aggregate liability for all claims under these Terms is limited to the total subscription fees paid by you to CareLinc in the twelve (12) months preceding the event giving rise to liability.

16. Indemnity

You agree to indemnify and hold harmless CareLinc, its officers, employees, and agents from any third-party claims, losses, liabilities, or legal expenses arising out of your breach of these Terms, unlawful handling of participant data, or unauthorized account activities.

17. Suspension, Termination & Data Export

Either party may terminate a subscription account in accordance with subscription contract terms. Upon termination, customer organisations may request data exports (e.g. CSV or PDF records) within 30 days of termination. Following the export window, CareLinc may permanently archive or delete account records in accordance with record-keeping rules.

18. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia [REQUIRES BUSINESS CONFIRMATION]. You irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales for resolving any dispute arising under these Terms.

19. Contact Information & Updates

We may update these Terms periodically. Continued use of CareLinc following publication of updated Terms constitutes acceptance.
